HOW TO CLOSE A STREET OR ALLEY

PLEASE NOTE: The entire process of closing a street or alley usually takes three months.

 

In the City of Knoxville

Any request to close a street or alley must be made with a formal application obtained from the Metropolitan Planning Commission and accompanied by the appropriate fee. The application must include the signatures of every resident and property owner adjoining the portion of the street to be closed, indicating either support or opposition to the requested closure. A successful closure effort typically must be supported by everyone involved.

All applications for a closure are reviewed by utility companies, city engineers, and the police and fire departments. If there are no objections, and if the right-of-way is not needed for public access to the area, the MPC staff will recommend that the closure be approved.

The closure will be voted on by the Planning Commission at one of their regular public meetings, held on the second Thursday of each month in the City County Building. The standard deadline for submitting a closure application is 32 days before a meeting. The deadline can be extended by two weeks by paying double the application fee. If the Planning Commission approves the closure, the application is passed to the City Council, which will close the street or alley by ordinance.

Upon application to the City of Knoxville Law Department, 215-2050, property owners adjoining the closure will be issued a quit claim deed for their portion of the right of way, usually extending to the streetís center line. There is a fee charged by the Law Department for these deeds.

 

In Knox County

A written request for a closure must be filed with the Knox County Department of Engineering and Public Works at 205 W. Baxter Avenue or call 215-5800. The request must include a survey of property owners as well as other information. Contact the county engineering department for complete instructions.

Final decisions on all county road closures are made by the Knox County Commission. Quit claim deeds will be issued by the Knox County Law Department, 215-2327.
